Warranty obligations

The Seller is liable for any non-conformity of the Goods with the contract existing at the time of delivery of the Goods to the Buyer and revealed within 2 (two) years from that time, unless the expiry date of the Goods is longer.
If the goods are found to be inconsistent with the contract, the Buyer has the rights specified in Article 43d et seq. of the Consumer Rights Act. The Buyer's rights specified in the preceding sentence are exercised in accordance with the provisions of the Consumer Rights Act.

If a Non-Conformity is discovered, the Buyer may file a complaint requesting:
1) repair the Goods, or
2) replacement of the Goods.

Complaints should be submitted electronically to sales@navin.pl.

The complaint should include:
1) name and surname of the Buyer;
2) email address;
3) Order number;
4) date of delivery of the Goods;
5) description of the Non-Conformity discovered;
6) demand repair or replacement of the Goods.

If the Seller receives a request:
1) repair of the Goods – the Seller has the right to replace the Goods;
2) replacement of the Goods – the Seller has the right to repair the Goods;
– if bringing the Goods into compliance with the Sales Agreement in the manner chosen by the Buyer is impossible or would require excessive costs from the Seller.
If the replacement of the Goods and the repair of the Goods are impossible or require excessive costs from the Seller, the Seller may refuse to bring the Goods into a condition consistent with the Sales Agreement.

After considering the complaint, the Seller sends the Buyer a response to the complaint, in which:
1) accepts the complaint and indicates the planned date for fulfilling the Buyer's request;
2) refuses to bring the Goods into a condition consistent with the Sales Agreement;
3) rejects the complaint due to its unfounded nature.

The Seller will respond to the complaint by e-mail within 14 (fourteen) days of its receipt.
If the Seller accepts the complaint, the Seller will, at its own expense, restore the Goods to a condition consistent with the Sales Agreement within a reasonable time from receipt of the complaint and without undue inconvenience to the Buyer, taking into account the nature of the Goods and the purpose for which they were purchased. The Seller will indicate the expected date for restoring the Goods to a condition consistent with the Sales Agreement in its response to the complaint.
The Buyer provides the Seller with the Goods for repair or replacement. The Seller collects the Goods from the Buyer at its own expense.
The Buyer is not obliged to pay for normal use of the Goods that were subsequently replaced.

In the event of a Non-Conformity being discovered, the Buyer may submit to the Seller a declaration of price reduction or withdrawal from the Contract if:
1) The Seller refused to bring the Goods into a condition consistent with the Sales Agreement;
2) The Seller has not brought the Goods into a condition consistent with the Sales Agreement;
3) the non-conformity of the goods with the contract persists despite the Seller's attempt to bring the goods into conformity with the contract;
4) the non-conformity is so significant that it justifies withdrawal from the Sales Agreement without prior notice to the Seller to bring the Goods into conformity with the Sales Agreement;
5) it is clear from the Seller's statement or circumstances that the Seller will not bring the Goods into compliance with the Sales Agreement within a reasonable time or without excessive inconvenience to the Buyer.

A declaration of price reduction or withdrawal from the Sales Agreement may be submitted electronically to sales@navin.pl.

The declaration of price reduction or withdrawal from the Sales Agreement should include:
1) name and surname of the Buyer;
2) email address;
3) Order number;
4) date of delivery of the Goods;
5) description of the Non-Conformity discovered;
6) indication of the reason for submitting the declaration;
7) a declaration of a reduction in the price of the Goods together with an indication of the reduced price of the Goods or a declaration of withdrawal from the Sales Agreement.

The reduced price must be proportional to the price resulting from the Sales Agreement to the value of the Goods that are inconsistent with the Sales Agreement. The Seller shall reimburse the Buyer for any amounts due for exercising the right to reduce the price immediately, no later than 14 (fourteen) days from the date of receipt of the price reduction notice.

The Buyer may not withdraw from the Sales Agreement if the non-conformity is immaterial.

In the event of withdrawal from the Sales Agreement, the Buyer is obligated to immediately return the Goods to the Seller at their own expense. The Goods should be sent to the following address: NAVIN PL SP.zOO 31-752 Kraków, ul. Kornela Makuszyńskiego, 15.

The Seller will refund the price of the Goods to the Buyer immediately, no later than 14 (fourteen) days from the date of receipt of the Goods or provision of proof of their return, whichever comes first. Refunds will be made using the same payment methods used by the Buyer in the original transaction, unless the Buyer has expressly agreed to a different refund method that does not incur any costs for them.
